Terms & Conditions for All Purchases

The following terms and conditions apply to all purchases by Environmental Reclamation Services, LLC. We ask that you read this information carefully. If you have any questions concerning these terms and conditions, please call 1.800.842.9923.

Seller represents and warrants that the goods and services furnished hereunder do not and will not violate or infringe any patent, trademark, copyright, trade secret or other intellectual property rights of any person and, if applicable, may be refurbished for sale in the United States. Seller further represents and warrants that any goods furnished hereunder that are new or used inkjet or toner cartridges were collected by Seller or its agents solely within the United States, and were sold by the OEM for use in the United States. Notwithstanding anything to the contrary, Buyer does not agree to purchase any new or used inkjet or toner cartridges that cannot be refurbished for resale within the United States. Any or all goods and services not complying with the requirements hereof, may be returned at Seller's risk and expense, including transportation both ways, or prompt correction of defects in addition to any other rights and remedies provided law or the Purchase Order. Payments by Buyer. shall not constitute acceptance nor waive any rights of Buyer hereunder.

Terms & Conditions for All Domestic Buys of 250 or More Cartridges

The following terms and conditions apply to all domestic cartridge purchases by Environmental Reclamation Services, LLC. We ask that you read this information carefully. If you have any questions concerning these terms and conditions, please call 1.800.842.9923.

• Cartridge Packaging
  All cartridges must be packed so as to avoid damage during shipping. All shipments are carefully inspected as they are received at our warehouse and evidence of physical damage to the shipment is documented. This is done so that any discrepancy which may occur as a result of broken or damaged cartridges can be rectified through a freight claim with the appropriate carrier. In the absence of physical damage to the boxes or containers in which the cartridges are shipped, ERS has no recourse to file a freight claim. Therefore, in these instances, the liability for broken cartridges rests with the cartridge seller. Please review our packaging guidelines.
• Payment
  All cartridges purchased by ERS will be paid within the terms listed on the issued purchase order after completion of inspection of the cartridges.
• Shipping
  The following guidelines apply to all cartridges purchased by ERS
  • For 250 or more laser cartridges, ERS will arrange shipping and pay freight charges contingent upon freight quote.
  • For 250 or more inkjet cartridges, seller should arrange shipping with UPS or a comparable carrier. ERS will reimburse shipping charges at a rate of $.08 per inkjet cartridge.
  • For inkjet orders of 1,000 or more inkjet cartridges, ERS will arrange shipping and pay freight charges.
  • For laser/inkjet combinations of 250 or more and weighing less than 300 lbs, seller should arrange shipping with UPS or a comparable carrier. ERS will reimburse shipping charges at a rate of $.80 per laser cartridge and $.08 per inkjet cartridge.
  • All additional costs associated with shipping, including but not limited to: labeling, re-weighing, customs, GST, inside delivery, lift-gate, re-delivery, residential delivery or repackaging, will be the responsibility of the seller.
• Cartridges not listed on your purchase order
  
  • Cartridges received that do not appear on your signed purchase order may be subject to a fee of $1.00 per laser cartridge and $.50 per inkjet cartridge. This fee is to cover ERS' costs incurred for shipping, handling, and disposal. If you have any questions regarding this fee, please contact your ERS representative.
  • Any non-value items will be disposed of upon completion of an order. Arrangements must be made prior to inspection if you want these items returned. Return shipping will be the responsibility of the seller. Items will only be held for 7 days and will be disposed of if shipping has not been arranged.
• Minimum Shipment
  ERS will not issue a purchase order or process payment on shipments containing less than the following:
  • Inkjets: 250 pieces
  • Laser: 250 pieces
  • Or a combination of inkjet and laser cartridges totaling 250 pieces
  If you have less than 250 pieces, please use the ERS Easy Parcel Ship Program .

  Due to increasing freight costs, ERS will no longer be responsible for lift gate charges or additional fees associated with residential pickups. These charges are the sole responsibility of the seller.

Terms & Conditions for All International Container Purchases

The following terms and conditions apply to international container purchases by Environmental Reclamation Services, LLC. We ask that you read this information carefully. If you have any questions concerning these terms and conditions please call 1.800.842.9923.

• Cartridge Packaging
  In addition to the following guidelines, all cartridges must be packed so as to avoid damage during shipping.
  • Pack only one type of cartridge per skid. Any variations should be clearly noted.
  • Pack only one cartridge type per individual box.
  • Label each box clearly with the enclosed cartridge type and quantity.
  • Packing should be neat and uniform with no tape or bubble wrap. Filler should occupy the empty space in boxes.
  • Quantities shipped should match purchase order exactly. Any changes should be approved by an ERS representative before shipping.
  Packaging suggestions are available upon request from your ERS representative.
• Payment
  
  • Payment is contingent upon the receipt of cartridge models, agreed upon in order, in acceptable condition. Models that do not appear in the purchase order will be subject to current published rates.
  • Buyer reserves the right to reject and return at seller's expense any item that contains defective material or does not conform to the purchase order.
  • Broken, cracked and non-virgin cartridges received by ERS that are not reflected in your signed purchase order may be subject to a fee of $1 per laser cartridge and $.50 per inkjet cartridge. This fee covers costs incurred by ERS for shipping, handling and disposal. If you have any questions about this fee, please contact your ERS representative.
• Shipping
  The following guidelines apply to all cartridge purchases by ERS from international sellers:
  • ERS will arrange shipping and pay freight charges contingent upon an approved freight quote.
  • Once the purchase order has been confirmed by seller, seller has up to five days to load units. ERS must be informed within 48 hours from when purchase order is received by seller, the date when product will be available to load.
  • Seller must provide ERS with documentation identifying any deviation between the initial purchase order issued by ERS and the inventory packaged in the container. Any changes must be approved by both parties before container leaves location.
  • Seller must inform ERS of the following:
    • The date the container is transferred from seller's location into the possession of the freight company agreed upon by both seller and ERS.
    • The date the container is scheduled to leave port.
    • The ship line or transportation company scheduled to transport the container.
    • Container's number.
    • Estimated time of the container's arrival at ERS facilities.
